ORDINANCE NO. 32
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF PAULLINA, IOWA, BY AMENDING PROVISIONS PERTAINING TO DESTRUCTION OF WEEDS.
Be it Enacted by the City Council of the City of Paullina, Iowa:
SECTION 1. TITLE III–PUBLIC ORDER PROTECTION AND LAW ENFORCEMENT, CHAPTER 2: NUISANCES, ARTICLE 8–GENERAL PROVISIONS, SECTION 8.03(6)
“DESTRUCTION OF WEEDS” is hereby amended as follows:
- DESTRUCTION OF WEEDS. The cutting or destruction of weeds or other growth which constitutes a health, safety, or fire hazard. (Code of Iowa, Sec. 364.12(3)(g))
A. Weeds, grasses, or other growth shall not be allowed to grow to a height greater than eight (8) inches on the average. This provision shall not apply to prairies, wetlands, or similar areas of naturalized perennial vegetation which are certified by an Enforcement Officer to not constitute a nuisance. In the event of failure to comply, the City of Paullina shall enter the property and destroy said weeds or other growth at the property owner’s expense.
SECTION 2. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be judged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 3. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
