ORDINANCE NO. 2024-001
AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF SUTHERLAND, IOWA, BY AMENDING AND ADDING PROVISIONS PERTAINING TO CHAPTER 55 – ANIMAL PROTECTION AND CONTROL.
Be it Enacted by the City Council of the City of Sutherland, Iowa:
SECTION 1. SECTION MODIFIED. CHAPTER 55: Animal Protection and Control. 55.01 DEFINITIONS. #7: Livestock- is hereby amended to not include chickens.
SECTION 2. SECTION MODIFIED. The Municipal Code of the City of Sutherland, Iowa shall be and the same is hereby AMENDED BY ADDING SUBSECTION 55.20 to CHAPTER 55: Animal Protection and Control. and reenacting the same to state as follows:
55.20 CHICKENS. “Chickens” shall mean a member of the subspecies Gallus gallus domesticus, a domesticated fowl. The maximum number of chickens an owner shall have within the City of Sutherland is five (5). An owner may only have female chickens located within the city. Chickens must be kept in an enclosure or fenced area at all times and must be secured inside a henhouse during non-daylight hours. All chickens must be kept twenty-five (25) feet from neighboring residences and cannot be kept in the owner’s front yard. Odors from chickens, chicken manure, or other chicken substances shall not be perceptible beyond the boundaries of the owner’s property. All stored manure must be covered by a fully enclosed structure with a roof. No more than three (3) cubic feet of manure shall be stored on the owner’s property. Noise from chickens shall not be loud enough to be heard beyond the owner’s property. Chickens cannot run at large. The term “run at large” is defined as any chicken freely roaming in any area not on the premises of its owner. No dog, cat, or other domesticated animal that kills a chicken while the chicken is running at large shall be considered a dangerous or vicious animal.
It shall be unlawful for any person to keep chickens inside a single-family dwelling unit, slaughter chickens inside the city limits of the City of Sutherland, or keep chickens on a vacant lot or uninhabited tract of land.
Any violation of this Section which constitutes a health hazard or interferes with the use and enjoyment of neighboring property is a nuisance and may be abated under the general nuisance abatement procedure as set forth in the City of Sutherland’s Code of Ordinances and is subject to a council decision on whether the resident can continue to own chickens.
SECTION 3. SEVERABILITY CLAUSE. If any section, provision or part of this ordinance shall be judged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 4. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
