NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS

These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the City of Primghar.
REQUEST FOR RELEASE OF FUNDS
On or after April 17, 2023, the City of Primghar will submit a request to the State of Iowa, Iowa Economic Development Authority for the release of Community Development Block Grant funds under TITLE 1 of the HOUSING AND COMMUNITY DEVELOPMENT ACT OF 1974, as amended (P.L. 97-35) to undertake the following project:
Project Title: Primghar Wastewater Treatment System Improvements Project
Purpose: The City currently operates a 3-cell facultative lagoon system that functions as a controlled discharge facility. The facility is permitted as a controlled discharge facility with an AWW-180 design flow of 0.1224 million gallons per day (MGD) and a BOD5 design capacity of 163 lb/day. It discharges to Unnamed Creek which then flows to Dry Ruy Creek, Mill Creek, and eventually to Little Sioux River. The existing facility has been hydraulically overloaded in recent years and an industrial user is expanding, creating more flow and BOD to be treated. The City will have to increase the hydraulic and organic treatment capacity to allow this industry to expand and to allow for future growth of the community. If no improvements are made to the treatment system, then growth in the community will be limited and industries will not be able to grow. Additionally, even with no growth the current treatment system cannot adequately treat the waste waters generated by the City and be in compliance with IDNR regulations and standards.
Completion of the project will provide the wastewater treatment facility with the hydraulic and loading capacity required to accommodate a growing industry and allow additional population growth while achieving compliance with current and future IDNR limits (regulations and standards).
The project consist of the construction of a new wastewater treatment system. The system is a SAGR System. The wastewater will enter a new inlet works building where it will be screened before flowing by gravity through aerated lagoons, the SAGR polishing reactors, and UV disinfection system before being discharged to Unnamed Creek.
Location: City of Primghar, Iowa. East of City, south of 390th Street/County Rd. B40, and north of 400th Street and this is the site of the current wastewater lagoons.
Estimated Cost: $6,861,000. Funding $300,000 Federal HUD and Iowa SRF loan fund of $6,561,000.
FINDING OF NO SIGNIFICANT IMPACT
The City of Primghar has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at Primghar City Hall, City Clerk’s Office, 160 S. Hayes Avenue, Primghar, Iowa 51245 and may be examined or copied weekdays, Monday-Friday 8:00 A.M to 4:30P.M.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the City of Primghar City Clerk/Administrator. All comments received by April 14, 2023, will be considered by the City of Primghar prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The City of Primghar certifies to Iowa Economic Development Authority that Kurt Edwards in his capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. Iowa Economic Development Authority’s approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Primghar to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
The Iowa Economic Development Authority will accept objections to its release of funds and the City of Primghar’s certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Primghar; (b) the City of Primghar has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Iowa Economic Development Authority; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to Iowa Economic Development Authority at 1963 Bell Avenue, Suite 200, Des Moines, IA 50315. Potential objectors should contact the Iowa Economic Development Authority to verify the actual last day of the objection period.
