Primghar Ordinance
ORDINANCE VACATING CERTAIN STREETS AND ALLEYS IN THE CITY OF PRIMGHAR, IOWA
BE IT ENACTED BY THE COUNCIL OF THE CITY OF PRIMGHAR, IOWA:
SECTION 1. Purpose. The purpose of this ordinance is to vacate the following described streets and alleys.
SECTION 2. Facts Found. The Council of the City of Primghar, Iowa, makes the following findings:
1. The following described streets and alleys are not needed for the use of the public, and therefore, it is justified to abandon said streets and alleys so that City resources need not be expended to maintain them.
2. The vacation will not deny owners of property abutting on said streets or alleys reasonable access to their property.
3. Notice of the intended vacation, including the date of which the Council will first consider the vacation, has been published not more than twenty (20) days nor less than four (4) days prior to the date set for the hearing pursuant to 2025 Iowa Code Sec. 362.3.
SECTION 3. Vacation. The following described portions of streets and alleys are hereby vacated:
Alley lying West of Lots 11 thru 15 and East of Lots 16 thru 20 in Block 6 in the Replat of Block 6 and the East 264 Feet of Outlot 1 in Shuckís Addition in the City of Primghar, OíBrien County, Iowa.
4th Street NW lying between Block 6 and Block 10 in the Replat of Block 6 and the East 264 Feet of Outlot 1 in Shuckís Addition in the City of Primghar, OíBrien County, Iowa.
Alley lying East of Lots 11 and 15 and West of Lots 1 thru 10 in Block 10 in the Replat of Block 6 and the East 264 Feet of Outlot 1 in Shuckís Addition in the City of Primghar, OíBrien County, Iowa.
5th Street NW lying between Block 10 and Block 11 in the Replat of Block 6 and the East 264 Feet of Outlot 1 in Shuckís Addition in the City of Primghar, OíBrien County, Iowa.
Alley lying East of Lots 10 and 14 and West of Lots 1 thru 9 in Block 11 in the Replat of Block 6 and the East 264 Feet of Outlot 1 in Shuckís Addition in the City of Primghar, OíBrien County, Iowa.
SECTION 4. Repealer. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed.
SECTION 5. Severability Clause. If any section, provision or part of his ordinance shall be adjudged invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional.
SECTION 6. When effective. This ordinance shall be in effect after its final passage, approval, and publication as provided by law.
On June 10, 2025 Ordinance #2025-03 was introduced by Councilperson _ and seconded by Councilperson to approve wage and benefits for the above employees.
